Humina – Terms of Service (US Version)

1. Agreement to Terms

These Terms govern your use of the Humina mobile application. By accessing or using the app, you agree to be bound by these Terms.

2. Service Description

Humina provides AI-generated conversations across different themed personas. The service:

• uses AI to generate responses;
• is for lifestyle, wellbeing, and general support;
• is not medical, psychological, legal, mental health, or financial advice;
• must not be used in emergencies or crisis situations.

We make no claim that AI outputs are accurate or safe to rely on.

3. Eligibility

You must be at least 18 years old and reside in the United States.

4. Accounts

To access premium features, you must create an account using Apple, Google, or phone number login.

You are responsible for maintaining the confidentiality of your account and all activity that occurs under it.

5. Subscriptions & Billing (US)

• Subscriptions and trials are processed by Apple App Store.
• Prices and renewal terms are displayed inside the app.
• Subscriptions renew automatically unless cancelled at least 24 hours before renewal.
• Refunds must be requested through Apple.

6. User Conduct

You agree not to:

• use the service unlawfully;
• attempt to extract or reverse-engineer AI models or outputs;
• submit harmful, abusive, or prohibited content;
• harass, threaten, or harm others;
• misuse the service in ways not intended.

We may suspend or terminate your account for violations.

7. No Medical or Professional Use

Humina does not provide:

• medical advice;
• mental health treatment or diagnosis;
• counselling services;
• legal or financial advice;
• any form of licensed professional service.

For emergencies, call 911 or your local emergency number immediately.

8. AI Behaviour and Safety

AI responses may be:

• unpredictable;
• incorrect or misleading;
• unsuitable for important personal or professional decisions.

You use the service at your own risk. The app includes moderation and filtering, but no system is perfect.

9. Privacy & Data Collection (US)

We collect:

• account details (email/phone, login provider);
• onboarding data (age, sex, language, location);
• device identifiers and IP address;
• analytics data and usage events;
• subscription status;
• push notification preferences.

We do not collect or store chat messages (these remain on your device only).

10. Third-Party Services

Humina uses third-party services, including but not limited to:

• Apple In-App Purchases;
• Firebase Authentication and Remote Config;
• Supabase for user profile storage;
• Analytics providers.

Your use of Humina also constitutes your agreement to the terms of those services where applicable.

11. Disclaimers

Humina is provided “as is” and “as available”, without warranties of any kind, whether express or implied.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee accuracy, reliability, or availability of the service.

12. Limitation of Liability

To the maximum extent permitted under US law:

• we are not liable for any indirect, incidental, special, consequential, or punitive damages;
• our total liability for any claim arising from or related to the service shall not exceed the amount you paid for the service in the past 12 months.

Some states do not allow certain limitations; in such states, these limitations apply only to the extent permitted by law.

13. Termination

You may delete your account at any time in the app. We may suspend or terminate your access to the service at our discretion, including for any violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
